Rules on Personal Data Handling

1. Information on restu

1.1. These Rules on Personal Data Handling have been adopted by Restu s.r.o., Id. No.: 289 93 063, a company with its registered office in Prague 5 – Stodůlky, at Jeremiášova 1249/7, Postal Code 15500, registered in the Commercial Register kept by the Municipal Court in Prague under File No. C 158483 (hereinafter “Restu”).

1.2. These Rules lay down the principles of personal data processing with respect to all users of the website at or the Restu application (hereinafter “users”), including users whose personal data are processed after they make a reservation directly with a partner restaurant on its website, or in some other manner where they provide their personal data (hereinafter “guests of partner restaurants”). 1.3. Restu processes personal data as a data controller only in respect of personal data of those users who create their account or purchase goods in the Restu store. In this case, Restu determines for what purpose and using what means the personal data will be processed.

1.4. In other cases where users make a reservation in a partner restaurant through the Restu website or application, or the website of a restaurant using the Restu widget, Restu is in the position of personal data processor. In these cases, the controller is directly the restaurant where the reservation has been made.

2. What data do we process?

2.1. Data provided by users and guests of partner restaurants. Restu processes primarily personal data that you provide to us yourselves when creating an account, making a purchase in the Restu store or publishing a user review, and also data that you provide for the purposes of arranging a reservation in our partner restaurants. These data include, in particular, the name and surname, e-mail address and telephone number, and possibly further information that you provide voluntarily. Furthermore, Restu may process personal data on the guests of partner restaurants, in particular the name, surname and e-mail address, if the restaurant submits these data to Restu with a view to arranging a reservation or if these data are kept in the electronic reservation book supplied by Restu.

2.2. Data from facebook. If you use the facebook social network for logging in, you will thus also allow Restu to access your public profile and e-mail address. Your public facebook profile includes your name and surname, the profile picture, age category, sex and further public information according to your settings.

2.3. Data obtained through cookies. In order to achieve better targeting of advertising campaigns and improve its offer of products and services, Restu uses information on your reservations and purchases. If you have enabled the use of cookies within the relevant settings on the Restu website or in your browser and agree with their use, Restu thus obtains data on your visits to the website, your preferences and further activity on the website.

2.4. Data obtained through customer helpline. In order to improve the quality of its services and resolving customers’ requests, Restu operates a customer helpline and may record the calls you make at this helpline. You will always be informed in advance that the call will be recorded. The recordings are stored only to deal with requests for the benefit of the user’s legitimate interests. Restu may process your name, surname, telephone number and further information you specify during the call.

2.5. If you voluntarily disclose any sensitive data in the note when making a reservation, e.g. regarding food allergies and other health limitations, then Restu will process these data exclusively for the purposes of arranging your reservation.

2.6. Restu is unable to check all content formed directly by users. If you state or publish any personal data concerning third parties when making a reservation, evaluating a partner restaurant or using the Restu website and application in some other way, you are responsible for ensuring that the third parties have granted their consent to such publication of their personal data. If any user determines that personal data have been disclosed at variance with these Rules, the user may contact Restu using the contact details set out in these Rules.

2.7. Only persons over 15 years of age may make a reservation, purchase and/or registration on the Restu website.

3. For what purposes do we process data?

3.1. To arrange your reservation, we use your name, surname and contact details. In this case, this information is transferred within the data processing to the partner restaurant you have chosen. If these data are not provided, Restu will be unable to arrange your reservation.

3.2. To arrange your purchase in the Restu store, we use your name, surname, contact details and, if specified by you, also invoicing details. If these data are not provided, Restu will be unable to deliver your order.

3.3. To offer our services and promote Restu and the partner restaurants by means of commercial communications sent to the users, Restu uses primarily the e-mail address, and occasionally also the telephone number for sending SMS. The processing takes place in this case only with your prior consent, which is fully voluntary. You grant your consent to Restu when making a reservation, making a purchase in the store or registering yourselves on the Restu website, or later in the settings of your member account.

3.4. If you have visited one of our partner restaurants, your name and surname, e-mail address, and occasionally also telephone number for sending SMS, may be used to promote that restaurant’s offer. In this case, personal data processing takes place, not on the basis of your consent, but rather based on a legitimate interest of the partner restaurant. The receipt of commercial communications from a partner restaurant may be cancelled at any time, or an objection may be raised against such processing of personal data with the partner restaurant. Unless the personal data are used by Restu also for some other purpose with your consent or on some other statutory ground, Restu will not further process these personal data after their transfer to the partner restaurant. As from the time of transfer of data, the partner restaurant is solely responsible for processing of the personal data.

3.5. A user review published by you and indicating your name and surname, or username, and your photograph, as appropriate, may be used for the promotion of the partner restaurants and/or the Restu website. The processing takes place exclusively on the basis of your consent which you grant by publishing the review.

3.6. If you have the relevant function enabled, we can send you “push notifications” directly on the website interface or through the Restu application. Information on the device you use will be utilised for these purposes. These notifications are displayed based on your consent granted after the relevant notification has been displayed on the website interface or by setting the Restu application accordingly. The settings may be changed at any time in your browser or in the application’s settings.

3.7. For better targeting of its advertising and promotion, Restu uses cookies to process data on visits to the website, the products viewed and further activities on the Restu website. Furthermore, the preferences that you specify yourselves in your account are processed for this purpose. This processing is possible only with your prior consent. On the basis of the data collected, Restu obtains statistics, analyses and reports on the behaviour of users of the Restu website. On their basis, it is then possible, in particular, to improve the targeting of our advertising or adjust the contents of our website to what you really are interested in and what you are looking for. 3.8. Restu operates a customer helpline to deal with your queries. For this purpose, Restu may process data on your name, telephone number and other data you state yourselves during the call. Restu may record your calls at the helpline with a view to meeting your requirements based on your legitimate interest. You will always be informed of the recording in advance. If you disagree with recording your call, you can obviously use other contact details of Restu.

4. Revocation of consent and unsubscription from receipt of commercial communications

4.1. Commercial communications. The users and guests of partner restaurants may unsubscribe from the receipt of commercial communications from Restu or a partner restaurant at any time:

  • by clicking on the relevant link provided in the footer of each commercial communication; or
  • by raising an objection to personal data processing with Restu, at the e-mail address, or using other contacts details specified in these Rules.

4.2. Cookies. Restu uses cookies to ensure functionality of its website and to adjust it as required. Cookies are further used for statistical monitoring of the manner of use of the website and for marketing purposes. If you want to disable cookies on your device, you can change the settings by clicking on the link “Cookies settings” in the footer of the Restu website or change the settings directly in your browser. If you disable Restu’s cookies, certain parts of the website might not function properly. More information on disabling and deleting cookies is available here.

4.3. Customer helpline. Restu will destroy any data obtained within recorded calls if you revoke your consent to their processing. Consent may be revoked using any contact details specified in these Rules.

5. Who has access to data?

5.1. Primarily, personal data are processed by Restu and by the partner restaurants you have actually visited or where you have sought reservation. Everyone at Restu who has access to personal data is obliged to maintain confidentiality and this obligation continues to apply even after they cease co-operating with Restu.

5.2. Furthermore, in the position of data controller, Restu authorises further entities to process personal data in the position of processors. Processor means any entity that processes personal data for Restu for the purposes and in the manner specified by Restu. The processor may not extend these purposes in any way. Where the processing requires your consent, this may take place only once consent is granted. We transfer to the processors only those data that they need to provide their services. The processors used by Restu include:

6. For how long do we process data?

6.1. Restu processes personal data for the purpose of performing the Agreement throughout the process of arranging a reservation or purchase in the Restu store and during the entire term of your registration. On the basis of the law, Restu subsequently stores certain data contained in accounting documents. In the case of personal data that are processed by Restu for partner restaurants in the position of processor, personal data may be processed not longer than until the end of the co-operation between Restu and the partner restaurant. In that case, Restu will transfer all the personal data to the partner restaurant and destroy any copies. Only the partner restaurant will then responsible for further processing of the personal data.

6.2. Commercial communications are sent to the users until their consent to receipt of commercial communications is revoked or until the account of a registered user is cancelled. In the case of guests of partner restaurants, commercial communications are sent by these partner restaurants until the guests unsubscribe from their receipt or until they object to processing of data for this purpose. However, commercial communications may be sent for a period not exceeding 5 years from granting the consent or the last visit to the partner restaurant. Then you will be invited by Restu or the partner restaurant to confirm that you continue to be interested in receiving commercial communications.

6.3. Data obtained for marketing purposes through the use of cookies are processed by Restu for the entire term of the consent to the use of cookies, i.e. for the time when cookies are enabled within the cookies settings on the Restu website or in their browser. The processing may continue after revocation of consent, but no longer than until the given type of cookies expires. You can find the deadlines pertaining to the individual types of cookies here.

6.4. We use data obtained using the customer helpline only for the period necessary to process your request, not exceeding 6 months.

6.5. Any data obtained within an evaluation of a partner restaurant you publish on the Restu website will be processed by Restu for the term of your registration or until you request that the processing of your personal data for these purposes be terminated. After expiry of your registration or after delivery of your request for termination of the processing, your evaluation will continue to be published on the Restu website in anonymous form.

6.6. Restu will continue to process personal data after said deadlines only if this is necessary for the performance of duties following from the legal regulations or contractual arrangements binding on Restu.

7. What are your rights?

7.1. In relation to personal data processing, you can contact Restu and request:

  • Information regarding the personal data processed by Restu in respect of the purpose and nature of the personal data processing, including information on any potential recipients of personal data outside Restu.
  • Access to the data you have provided to Restu when making a reservation, registration or purchase in the Restu store. If you exercise this right, Restu will confirm to you whether and, if so, what specific personal data are being processed and, if appropriate, these data will be disclosed to you together with the information on their processing.
  • Rectification of personal data if they are in any way inaccurate or incomplete. Restu is able to correctly arrange your reservation or purchase and keep properly your member account only if the data that it has available are up to date.
  • Explanation and removal of a defective state of affairs (e.g. blocking, rectifying, supplementing or destroying personal data) if you believe that Restu processes personal data at variance with protection of your personal and private life or at variance with legal regulations.
  • Erasure of personal data (the “right to be forgotten”) or their restricted processing if they are no longer necessary for the above purposes or if Restu no longer has a legal ground for processing the personal data, including cases where you disagree with their further processing. Restu will completely or partially destroy your data if the above conditions have been met.
  • Transfer of personal data processed by automated means by Restu to another entity in cases where the data were obtained with your consent; Restu will transfer your personal data in a commonly used format either to you or to some other controller according to your choice.

7.2. Furthermore, the guests of partner restaurants may object to personal data processing if commercial communications of partner restaurants are sent to them. This right can be exercised directly at the partner restaurant which processes the personal data for this purpose.

7.3. In addition the above authorisations, you can always file a complaint with the Office for Personal Data Protection in case of breach of Restu’s obligations.

8. Security

8.1. Restu strives to ensure security of your data. The handling of personal data is in full conformity with the applicable legal regulations, including the General Data Protection Regulation (GDPR). In processing personal data, Restu places great emphasis on technical and organisational security of the processed data.

8.2. All personal data in electronic form are stored in databases and systems to which access is enabled only to persons who need to handle the personal data directly for the purposes set out in these Rules, and only to the necessary extent. Access to these personal data is restricted by a password and firewall. Restu regularly tests the personal data security and we work continuously on improving the protection.
